A deposit, typically 10% of the purchase price, is paid at signing.

The most common form is the arras penitenciales, named for the legal regime that governs it under Article 1454 of the Spanish Civil Code. If you withdraw without cause, you forfeit the deposit. If the seller backs out, they must return double the deposit — your original amount back plus an equal sum as compensation.

Less common but worth knowing: arras confirmatorias do not carry this automatic penalty regime. Under this type, withdrawal gives rise to a damages claim rather than the fixed double-deposit rule. Make sure your arras contract specifies which type applies.

If you are confident in the purchase, a larger deposit can work in your favour. It signals commitment and makes the seller’s withdrawal considerably more costly.

Property Surveys

Surveys are not a standard part of the purchase process in Spain, and sellers have no legal obligation to disclose known defects. The condition of the property is the buyer’s responsibility to assess before purchase.

We recommend commissioning an independent survey, particularly for older properties. Common issues in Spanish properties include roof condition, rising damp, drainage problems, structural cracking, old electrical wiring, and inadequate insulation. Properties in coastal areas may also show corrosion damage from salt air.

If utilities are turned off during your visit, consider adding a clause to the arras contract making the seller responsible for faults in related equipment — boilers, electrical systems, plumbing — that emerge within 30 days of completion.

Significant survey findings may provide grounds for renegotiating the purchase price.

Custos e taxas de encerramento

Budget for approximately 10 to 13% of the purchase price in total closing costs. The main components are:

ITP (Impuesto sobre Transmisiones Patrimoniales) — the property transfer tax on resale properties. This is a regional tax and the rate varies significantly by autonomous community. Current reference rates: Madrid 6%, Andalusia 7%, Canary Islands 6.5%, Murcia 7.75%, Valencia 10%, Catalonia 10% (with higher progressive bands up to 11% for high values), Balearic Islands up to 13%. Confirm the current rate for your specific region with your lawyer before budgeting.

IVA and AJD for new builds. New build properties are subject to IVA (VAT) at 10% rather than ITP. In addition, stamp duty (Impuesto de Actos Jurídicos Documentados, or AJD) applies, with rates varying by autonomous community, typically between 0.5% and 1.5%.

Notary fees — typically €600 to €1,200, varying by property value and location. Many lawyers charge a flat fee or a percentage of the purchase price (commonly 1 to 1.5%). Agree this in writing before engaging.

In Spain, the real estate commission is paid entirely by the seller. If you are working with a dedicated buyer’s agent who charges a separate fee, this will be an additional cost agreed with them directly.

Mortgages for Expats in Spain

Financing is available to non-residents and foreign nationals, though the terms differ from those offered to Spanish residents.

Loan-to-value: Spanish banks typically offer non-residents a maximum of 60 to 70% of the appraised property value, meaning you will need a minimum of 30 to 40% as a down payment. For non-EU buyers or those without easily verifiable credit histories, lenders may cap this at 60%. Factor in an additional 10 to 13% on top of your down payment to cover taxes and closing costs.

Taxas: Mortgage rates in Spain vary depending on whether you choose a fixed or variable rate, the term, and the lender. Variable rates track the ECB Euribor. Fixed rates track around 2.75% to 3.5% for well-qualified borrowers. A mortgage broker will give you current market rates.

Limites de idade: Most Spanish banks will not issue mortgages where the term extends beyond the borrower’s 75th birthday. This affects the maximum term available to older buyers.

Histórico de crédito: You will need credit reports from your home country and any other countries where you have established credit. Most banks also require stable employment history or demonstrable income.

Repagamento antecipado: Spanish law caps early repayment penalties at 0.5% for variable-rate mortgages and 2% for fixed-rate mortgages.

Mortgage terms for non-residents are typically 20 to 25 years maximum.

A mortgage broker with experience in expat client financing will save you time and, in most cases, secure better terms than going directly to a single bank. We can connect you with a recommended broker in your target area.

Transferir Dinheiro para sua Compra

When transferring a large sum internationally, using a specialist currency exchange service rather than a standard bank-to-bank transfer will typically get you a more favourable exchange rate and lower fees. On a purchase of this size, the difference is worth pursuing. Note that the receiving bank in Spain may also apply a small commission on incoming international transfers — this is the buyer’s responsibility to cover. Some buyer’s agents operate within this model by splitting the seller’s agent commission. Others charge the buyer a separate fee in place of or in addition to any commission arrangement. Agree the fee structure in writing before you begin working together.

➡️ Speak with a StartAbroad relocation specialist about buyer’s agent recommendations for your target area.

Renting in Spain

For most expats, renting is the right first step. It gives you time to learn your preferred area before committing to a purchase, and satisfies the proof-of-accommodation requirement for most Spanish visa applications. Many clients rent for one to two years before buying, and some choose to rent indefinitely.

The rental market in Spain is highly competitive, particularly in Madrid, Barcelona, and coastal areas with strong demand. Real estate data reveals that average rental prices have risen over 34% in recent years, pushing median metrics to record levels. Well-priced properties move within days. Smaller cities and towns offer more availability and better value, and are worth serious consideration if flexibility on location is possible.

How Renting in Spain Works

Spain’s rental market is governed by the Ley de Arrendamientos Urbanos (LAU). Under active frameworks, the key terms are:

Lease length: The minimum mandatory lease term for residential properties is 5 years where the landlord is an individual, or 7 years if the landlord is a corporate company. This means that even if you sign a one-year lease, you have the structural legal right to renew it annually up to the 5- or 7-year minimum. Landlords cannot force you out before that point without narrow, legally proven personal grounds.

Tenant’s right to leave: You can terminate the lease after the first six months by giving 30 days’ written notice. Your contract may include a penalty clause for early termination, capped at one month’s rent per remaining unfulfilled year of the contract, but many agreements omit this entirely.

Rent increases: Annual rent updates are permanently unlinked from standard CPI. Instead, rent increases are strictly capped by the Reference Index for Housing Rentals (IRAV) published by the National Statistics Institute (INE). For the 2026 calendar year, the mandatory IRAV rent cap is set at 2.14%. Landlords cannot exceed this ceiling during annual reviews.

Lease agreements are in Spanish. Having your lease reviewed before signing is important. If you do not read Spanish fluently, a translated review by your lawyer or relocation specialist is well worth the cost.

A note on medium-term and 11-month contracts: these are now very common in Spain, particularly in Madrid and Barcelona, where landlords use them specifically to try to circumvent the LAU’s 5-year security mandates. A seasonal or temporary contract is only legally valid when the stay is genuinely temporary (e.g., studies or a temporary work project) and the property is not your primary, permanent residence. If you are moving to Spain long-term, courts can reclassify these contracts as standard residential leases, but it requires legal action. Go in knowing that an 11-month contract offers you fewer protections than a standard residential lease.

O que os proprietários exigem

To rent in Spain, you will generally need:

Um passaporte válido ou documento de identificação emitido pelo governo

Your NIE (Número de Identificación de Extranjero)

Proof of income — recent bank statements, pay stubs, or local employment contracts

It is standard for landlords to request proof of stable incoming revenue that matches at least 3x the monthly rental fee. Some landlords, particularly for high-value properties, may also request a tax return, a solid local guarantor (aval), or a larger upfront deposit allocation.

Deposits: Spanish law restricts landlords to collecting exactly one month’s rent as a legal security deposit (fianza), which must be formally lodged with the regional housing authority. Landlords are permitted to request an additional private financial guarantee, but this extra contractual buffer cannot exceed two months’ rent. The maximum cumulative total for all security guarantees combined is strictly capped at three months’ rent.

Onde encontrar imóveis para alugar

The main platforms for rental listings in Spain are idealista.com and fotocasa.es, supplemented by pisos.com. Habitaclia is widely used in Catalonia. Local Facebook groups and expat community boards can also surface opportunities, particularly in smaller towns and coastal areas.

Searching remotely from abroad is common and workable. Most landlords and agents are accustomed to coordinating video walkthroughs for international clients. That said, the competitive market in major cities means listings can disappear quickly, and having local support speeds up the process considerably.

Encontre seu aluguel com o StartAbroad

Our rental search service takes the logistical friction off your plate.
